WEST MILFORD — West Milford Police were called to Macopin Middle School on Thursday, April 20 at approximately 9:30 a.m. on a report from Dean of Students Denis Howes, that a student had been found to be in possession of pharmaceutical narcotics. School Resource Officer Steven Blacksmith responded to the school. An un-named teacher at the school observed a 15-year-old male student moving an object from pant pocket to pant pocket and overheard several other students talking about this individual having Oxycontin tablets, a narcotic pain reliever, in his possession and his desire to sell them. Upon receiving the report, Mr. Howes searched the student’s locker and discovered a Ziplock baggie containing 10 pills later identified as the narcotic. The youth admitted he had taken them from his residence and was planning to sell them at school. The drug had been prescribed for his father after a recent surgery. The youth was transported to police headquarters and released to his parents after processing. He was charged on juvenile petitions for Possession of CDS, Intent to Distribute CDS and Intent to Distribute CDS in a School Zone. If these crimes had been committed by an adult the charges would include two counts of a third degree crime with possible prison sentences ranging from five to ten years each and fines from $35,000 to $150,000, as well as a second degree count which could include imprisonment from 10 to 20 years and a fine of $25,000.00. A conviction of the charge of Intent to Distribute CDS in a School Zone would also mandate a minimum mandatory term of imprisonment to be determined by the court, for an adult violation. If the youth in this case were adjudicated delinquent in a juvenile court, any and all penalties and fines would be at the discretion of the Family Court Judge. There is no indication that the youth had actually had an opportunity to sell any of the drugs prior to his being taken into custody.
