Internet investigation uncovers another name, By JoAnn Baker WEST MILFORD The ongoing investigation to reveal the identities of people who were posting remarks anonymously on the Internet has netted another name. Attorney Jeff Warden, who represents the plaintiffs in a libel/slander lawsuit against the anonymous posters, filed a motion this week to change one of the aliases to Kenneth Freedman. The plaintiffs are Township Councilman James Warden and girlfriend Bettina Biere. They filed suit after a Web site called FleecingWestMilford.com published a story they claim was libelous and defamatory. The suit names a number of unidentified people, some of whom had posted inflammatory remarks on a public bulletin board forum. After filing the suit in January, Jeff Warden (brother to the Councilman Warden) launched an investigation to identify the people behind the screen names. Freedman, who Warden claims has been identified as WMGrad, is a former Board of Education member. He and running mate Dennis Kirwan (also named in the suit) ran for town council seats on the Republican ticket in 2004 but were defeated by Democrats Warden and Robert Nolan. In 2000, the township switched from a non-partisan to a partisan form of government. Some say the bad blood between the political parties has become the defining feature of the new form of government. Former Republican Councilman Joseph Elcavage resigned from the council in January amid allegations that he had been posting defamatory comments under an alias. Bierre and Warden ask for an unspecified amount for both compensatory and punitive damages and a trial by jury in the suit. The West Milford Messenger contacted Freedman for comment after obtaining a copy of the motion from the county courthouse. He said he was unaware he had been named and was unfamiliar with the suit.
